Terms of Service
Effective September 14, 2026
These terms are an agreement between Cakewalk AI Inc ("Cakewalk", "we", "us") and the business that uses our service ("you"). By keeping a site we built, paying for the service or using it, you agree to them. Our Privacy Policy and SMS Terms are part of these terms.
The service
We build and run a website for your business, publish it for Google and AI search, run a website chat and text assistant that answers your customers and books estimates, send review requests for jobs you tell us are done, and make changes you ask for by text. What's included is described on our home page and can improve over time. Features marked "coming soon" are not part of the service until we launch them.
Previews
We may build a preview site from public information about your business, such as your Google listing and current website. A preview is free, isn't indexed by search engines, and comes down at the end of its preview period unless you keep it. If you'd like a preview taken down sooner, tell us and we'll remove it.
Price, billing and cancelling
- The service costs $395/mo, billed monthly in advance. There's no minimum term.
- There's a one-time $1,200 setup fee. It's waived for our founding members.
- Payments are taken by our payment processor, Stripe; we never see your full card number. Your subscription renews each month until you cancel.
- Concierge, where we offer it, costs $995 a month, billed monthly.
- Founding offer: our first 10 businesses get 50% off their first 6 months of the monthly plan, and the setup fee waived.
- Referrals: when a business you refer becomes a paying customer, you each get one month's subscription free, credited to your next bill once they've paid their first month. One credit per business referred; referrals aren't exchangeable for cash.
- You can cancel any time, by text or email. Cancelling stops the next charge; the service runs to the end of the month you've paid for. Apart from the results guarantee below, we don't refund part months.
- If a payment fails and isn't fixed within 14 days of us telling you, we may pause the service until it is.
- We'll give you at least 30 days' notice before changing your price.
Results guarantee
If your site doesn't bring you at least 5 new customer enquiries in your first 90 days, we'll refund everything you paid us for that period, and keep running your site at no charge until it has brought you 5 enquiries, for up to 90 more days.
- What counts. A new enquiry through your site: a chat, a text or a booking request from a real customer (not spam), or a tap on your site's call button. Your dashboard shows the count.
- When it starts. The 90 days start on the day your domain points to your new site. We handle that switch with you.
- Conditions. Your Google Business Profile links to the site, you reply to enquiries within a day, and the site stays live for the 90 days.
- How to claim. Email or text us within 30 days after the 90 days end. We'll check the count and refund you to your original payment method. One guarantee per business.
Concierge
Concierge costs $995 a month, billed monthly, and is limited to a small number of businesses. It includes everything in the standard service, plus:
- Google Local Services Ads. We set up and manage your ads. Ad spend is paid by you directly to Google and isn't included. Google decides eligibility and approval, including its own background checks.
- Your Google Business Profile. We reply to your Google reviews within a day and post updates, offers and answers to questions. You add us as a manager; you stay the owner and can remove us at any time.
- New pages and listings. Two new pages a month on your site, and your business listed and kept consistent on Bing, Apple Maps, Yelp, Nextdoor and the BBB, where they accept it.
- Reporting and calls. A monthly visibility report and a monthly 30-minute call.
- Concierge results guarantee. The results guarantee above applies with 10 enquiries in place of 5.
Add-ons
Add-ons are billed monthly with your plan: Google Business Profile management ($149) and two new pages a month ($99). You can add or remove them from your next billing month.
The Cakewalk network
The Cakewalk network passes jobs between Cakewalk businesses when one can't take them: outside its area, a service it doesn't offer, or when it's booked out. It launches area by area, once enough Cakewalk businesses in a trade cover an area, and these terms apply to it where it has launched.
- Taking part. Both referring and receiving are opt-in, and you can switch either off at any time.
- The customer decides. A customer's details are passed on only after they say yes to that specific business, and the receiving business may use them only for that job, not for marketing.
- Referral fee. A receiving business pays $40 for each referral that books, shown before it accepts, and nothing for referrals that don't book.
- Referral credit. The referring business gets a $25 credit toward its next bill for each referral that books. Credits aren't cash, can't reduce a bill below zero, and end if the account closes.
What you're responsible for
- Giving us accurate information about your business, and telling us when it changes.
- The work you do for your customers: your prices, quotes, licenses, insurance, permits and anything you agree with a customer.
- Having the right to any photos, logos or text you send us to use.
- Following the laws that apply to your business, including advertising and contractor registration rules.
The assistant
The assistant answers your customers from the information you've given us and what you teach it. It won't quote prices, promise arrival times or commit you to a job unless you allow it, and bookings wait for your YES. It can still misunderstand or make mistakes, so read what it sends you and correct it when needed. You can pause it at any time by texting PAUSE.
Text messages
We text your customers only when they've agreed to it or texted first, and we honour STOP and HELP. You agree not to use the service to send marketing texts to people who haven't agreed to receive them. Message frequency, rates and opt-out details are in our SMS Terms.
Google and other services
Your site can show your Google rating, reviews and photos. They come straight from Google, under Google's terms, with Google's attribution, and we don't edit them. If you connect your Google Calendar, we only read when you're busy and add your bookings to it; you can disconnect it at any time. The service relies on providers such as hosting, texting carriers, AI model providers and our payment processor, and we're not responsible for their outages.
Your content and data
Your business information, photos, leads and bookings belong to you. You let us host, display, adapt and process them to run the service. You can export them at any time. After you cancel, we keep them available for export for 30 days, and after that we may delete them.
You own your domain. We only point it at your site with your permission, and we never change your email settings.
We may show your business's name and a link to your site as an example of our work, and include your site's enquiries in the overall numbers we publish, without any of your customers' details. Tell us if you'd rather we didn't, and we'll stop.
Our platform
We own the software, designs and templates we use to build and run sites. While you're a customer you can use them for your site; when you cancel, the site built on them comes down, and your content stays yours to take with you.
Acceptable use
Don't use the service for anything illegal, misleading or harmful: false claims about your business, fake reviews, spam, content you don't have rights to, or attempts to break or misuse the service. We may remove content or suspend a site that breaks this rule.
No other guarantees
Apart from the results guarantee, we don't guarantee search rankings, a number of leads or jobs, or revenue, and nobody can honestly promise a number-one ranking. We work to keep the service available and reliable, but it may sometimes be interrupted, including for maintenance. The service is otherwise provided "as is", to the extent the law allows.
Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits or lost business, and our total liability for any claim is limited to what you paid us in the 12 months before it arose. Nothing in these terms limits liability that can't be limited by law.
Indemnity
You'll cover us for claims brought by others that arise from your work for your customers, the content you give us, or your breach of these terms.
Ending the service
You can cancel at any time. We may end or suspend the service if you don't pay, if you seriously or repeatedly break these terms, or if we have to by law. Where we reasonably can, we'll tell you first and give you time to put things right and to export your data.
Changes to these terms
We may update these terms. We'll change the effective date above and tell you by text or email about material changes at least 30 days before they apply. If you keep using the service after that, the new terms apply; if you don't agree, you can cancel.
Law
These terms are governed by the laws of the State of Washington, and any dispute goes to the state or federal courts in King County, Washington.
